    • Platinum Point Yacht Club (at Burnt Store Marina – Charlotte Harbor)

      Platinum Point Yacht Club is located in the impressive Burnt Store Marina complex, which guards the eastern shores of Charlotte Harbor, well south of Punta Gorda. I have had the good fortune to speak at Platinum Point Yacht Club in the past, but I must say I did not know they featured their own dockage facilities.
      Platinum Point is not a member of the Florida Council of Yacht Clubs, but from my own experience and that reported by below by Captains Jim and Vaughn, this club is well worth a visit.

      Platinum Point Yacht Club is located at Burnt Store Marina on the east side of Charlotte Harbor. This is east of the ICW anchorage at Pelican Bay/Cayo Costa SP, south of Punta Gorda and north of Ft Myers/the Okeechobee waterway.
      They have a three docks at the marina. first night free, second and third night $1/ft. Call ahead for availability but they are mostly empty .
      The Burnt Store Marina also offers AGLCA Looper Discounts.

    • Shallow Depths Encountered at Field Yacht Club (Sarasota, FL – Statute Mile 71)

      Be sure to read all the remarks in both messages below before drawing any conclusions about the Field Yacht Club in southern Sarasota. As you will see, there are many positive attributes reported, but depths are clearly a problem at this facility for some vessels.
      I have had the good fortune to make presentations at the Field Club on many occasions over the years, and I have always been very impressed with the clubhouse and the greeting I received. As far as the wet slip dockage is concerned though, looks like it’s time for a dredging project!

      Yesterday we went into the SFC at mid-tide. We have a 50′ Ocean Alexander with a 4′ draft. They were expecting us. In the channel approaching them, our depth finder was reading .2!! We continued very slowly into the marina
      to our assigned slip. As we backed into the slip, we were churning up mud. We waited 3 hours for high tide and left. The marina had never warned us.

      After reading the above note, which originally appeared on the “GL” (Great Loop) Mail List, we e-mailed Captains Mar and Allyn, and asked for clarification as to whether the “SFC” was indeed the Field Yacht Club in southern Sarasota. We received the following affirmative reply:

      Yes it is the Field Yacht Club in Sarasota. A beautiful Club but for us the approach was very thin and the slip we got would have been a problem at dead low, which was in the morning when we would have had to leave. Don’t want to take anything away from the Club and they were great let us wait for the tide to come up and then we left, no charges for Electric or the slip. Very accommodating.

    • Controversial Martin County (Stuart, Florida) Anchorage Restrictions Approved by the Florida Department of Fish and Wildlife (FWC)

      On Wednesday, December 5, 2012, the Florida Fish and Wildlife Commission approved, with several modifications (see below), the proposed anchorage regulations for Martin County and Stuart, Florida. This is one of the five sites previously approved to take part in the Florida Pilot Mooring Field Program. As any of you familiar with this long, drawn-out process already know, the approved sites are given the right to regulate anchorage in their waters, IF AND ONLY IF THE REGULATIONS ARE APPROVED BY THE FWC!
      It is not stretching the truth at all to report that this particular set of regulations is the most controversial of the five sites participating in the pilot program, with the possible exception of St. Augustine’s 30-day anchoring limit, which was ultimately shot down by the FWC. The Salty Southeast Cruisers’ Net has published several previous articles on the proposed Martin County regulations (see /?p=100456).
      Now, with some FORTUNATE modification inserted by the FWC, these regulations have been approved, and will almost certainly go into effect shortly. ALL CRUISERS WHO EVER PLAN ON ANCHORING IN THE STUART, JENSEN BEACH REGION WILL WANT TO READ THE TEXT BELOW, AND LEARN ALL THERE IS TO KNOW! (See, I was a poet, and you did not know it!).
      First, let’s hear from our “man on the scene in Stuart, Florida, maritime attorney Captain Ted Guy:

      Basically, the City of Stuart is banning anchoring within 150 ft of the existing mooring field and other “marine infrastructure” (docks, seawalls, etc.) throughout the city limits (that provision is probably reasonable) and will require anchored cruisers in the City Limits to demonstrate navigable mobility of their boats and pumpout receipts every ten days.
      In the Manatee Pocket, anchoring will only be allowed in the charted small anchoring triangles (see the third map I sent you in October with the draft ordinance). The ordinance does not provide the exemption for live-aboards provided by Florida Statutes, an obvious legal omission.

      Meeting Wednesday in Apalachicola, the Florida Fish and Wildlife Conservation Commission (FWC) approved, with contingencies, the city of Stuart/Martin County’s proposed ordinance for the anchoring and mooring pilot program coordinated by the FWC.
      The ordinance is in response to the Florida statute allowing a specific number of local governments to adopt regulations on anchoring and mooring vessels in their jurisdiction. This pilot program provides an opportunity for the FWC and the Florida Legislature to evaluate the subject more fully.
      `The goal of the anchoring and mooring pilot program is to explore potential options for regulating the anchoring or mooring of non-live-aboard vessels outside the boundaries of public mooring fields,’ said Maj. Jack Daugherty, leader of the FWC’s Boating and Waterways Section. `The FWC’s role is to provide consultation and technical assistance on the issues.’
      Local governments for the five communities participating in the pilot program are responsible for soliciting public input and adopting local ordinances within their jurisdictions. These ordinances must be approved by the FWC and will continue to be evaluated by the FWC and the Legislature. FWC staff members have been attending the sites’ public-input meetings to provide information on the pilot program. Two meetings were held in Martin County on the topic.
      Rather than writing an ordinance that was countywide, city of Stuart/Martin County participants established four areas in the county in which the ordinance would be effective. They selected one in the Indian River, two in the St. Lucie River, and one in the area referred to as Manatee Pocket in Stuart.
      In the St. Lucie and Indian River locations, the ordinance prohibits anchoring and mooring within 300 feet of the mooring field and other maritime infrastructure. In the Manatee Pocket location, the prohibition applies to the whole area except within provided anchoring areas.
      `There is a ‘˜safe harbor’ exception in all areas for vessels anchored temporarily due to severe weather or mechanical issues,’ Daugherty said.
      For vessels that have been anchored in any of the areas for 10 consecutive days, the ordinance requires vessel operators to document that they can successfully navigate under their own power by visiting designated locations. After that first documentation of operability, they must also demonstrate compliance every six months.
      `This will ensure that boats can operate safely and will also deter abandoned or derelict vessels,’ Daugherty said. `This protects the marine environment and keeps waterways safe for all to use.’
      A final part of the ordinance is a requirement to demonstrate compliance with marine sanitation laws by providing proof that marine sanitation devices have been pumped out within the 10 previous days.
      Commissioners discussed the ordinance, asked questions and heard public comment, ultimately approving it with a few contingencies, including reducing the buffer distances in the St. Lucie River areas to 150 feet while still restricting anchoring between the Stuart mooring field and eastern shoreline. Commissioners also required the removal of the Indian River location until the associated mooring field is constructed.
      With this approval, the county can adopt the ordinance to make it effective. All ordinances adopted under the pilot program expire on July 1, 2014, unless re-enacted by the Legislature.
      The ordinances for St. Augustine, St. Petersburg, Sarasota and Monroe County have already been approved.

      Thanks to Mr. Guy and all the others that commented it appears the approved regulations are much more reasonable than the original proposal. However, as usual, the law is poorly written. For example, if one arrives, then anchors for 10 days, haven’t you already demonstrated that you can navigate your vessel? How else would you get there? If you sail away for a week and then return for another 10 days do you have to once again demonstrate you can navigate by going to a designated location? Do these laws also apply to boats on moorings? If not, why not? Also, how can one provide proof of pumpout if you don’t pumpout’“using a composting or incinerating system, or a porta pottie? This just further adds confusion to the hodge-podge of anti-anchoring ordinances in Florida that most boaters will be completely unaware of.

      My inclination is to plan on sailing through those areas, i.e. stop before & after; there are enough challenges without jumping through hoops and being hasselled. Current state law allows recovery of costs for ‘˜derelict’ vessels which go down or threaten safety of others from the registered owners. my 2c.

      How will boats with composting heads comply with the proof of pump out requirement?

      Some composting toilets are classified as `portable’ just like a porta potty. Because they don’t have holding tanks, they are exempt from such regulations. Believe it or not, the USCG prefers portable systems if it is possible and reasonable to use. Portable systems are much more difficult to discharge illegally because to discharge them you have to be conspicuous. You can’t simply go below and open a valve out of sight. Additionally, with a portable composting toilet, there is no urgency to empty the collection container and therefore no need to break the law.

      Being the only person aboard my boat with a 50 gal. holding tank, I only need a pump out twice a month, at the most. I last pumped out at Stuart Loggerhead Marina when I fueled and the receipt had no mention of a pump out. I keep a pump out logbook. If a logbook is sufficient for the FAA , why not for Martin County?

      I guess Stuart will just have to served notice of intent to suit for violation of civil rights afet the first ticket is issued to a composting boat, interesting politicians in that area, dumb would be a compliment.

      We are traveling the Great Loop Via “Ariverderci” Anchored out at Englewood, FL for the last two evenings. A great place to anchor and dingy into town. We anchored out for 2 nights. All went well.

    • Cruising the Western Florida Coastline With a 6-foot Draft

      The discussion below originally appeared on the T&T (Trawlers and Trawlering) mail list, which, by the way, is a nautical list WELL WORTH joining! We think there is sooooo much good info here about cruising the western coastline of the Sunshine State in a deeper draft vessel, we have reproduced the string here!

      With all of the available information out there, I would have thought that this question would be easy to answer on my own… but I really haven’t been able to figure this out.
      Our Selene draws six and is LOA 62. We are considering the possibility of a house purchase in the St. Pete to Naples area. Looks like a great area. So, we are planning a cruise up there from here in Key West for a week or so to check it out. Here’s the question: Where is it deep enough for our boat?
      I haven’t been able to ID any marinas that offer sufficiently deep entrances and reasonably easy/deep navigation routes from here in KW. This is enough of an issue for our little cruise; but, it also raises the issue of whether it is reasonable to own a boat like ours on the West Coast vs. the East Coast of FL. I know there are many fans of this area of the world on the list. Can any of you offer any encouragement on this point? Suggested routes/marinas?

      You might want to check out Punta Gorda. It is easily accessed through Boca Grande Pass and Charlotte Harbor. Fisherman’s Village Marina indicates a 7.5 ft approach at MLW and at least that at some of the docks. See www.fishville.com Winter low tides and strong North winds can make this less.
      Punta Gorda has a large collection of canals, a good portion are considered “sailboat” water which should accommodate your boat, but like all of the other deeper draft vessels, you likely would need to play the tides. A lot of us here enjoy having our boats in our back yards.

      Personal opinion, 6 feet draft is perfectly fine for FL West Coast. I have traversed from Ft Myers to Anclote with my boat, 5’3″ draft and have never bumped while inside the ICW channel. I have also done a delivery of an Irwin 65 with 6′ draft from St Pete to Miami (via Key West) with no draft issues. Many if not most marinas also can accomodate your draft. To name a few St Pete muni, Harborside, Gulfport (6’6″ depth) Twin Dolphin, Regatta Point, Rivera Dunes, Clearwater muni, Tierra Verde.
      One thing you will have to watch out for is sand bars stretching out to sea, sometimes for over a mile, from each and every pass. Come on up, the water is fine…

      Mike,
      Winter in Florida is when tides tend to be lower and water shallower. Tides on the gulf coast of western Florida are diurnal; one high tide per day, mostly in the mid-to-late afternoon. The pattern does vary slightly with new and full moon cycles. Western Florida is a shelf; not deep water. Most of south and west of Florida is “OK” – but not flush – for 6ft draft. There are some exceptions.
      When in Naples, research carefully the old ICW between Naples and Marco, through Goodland. The last time I mentioned that stretch – from Doctor’s Pass to Rookery Bay – I was told it I was nuts and it was fine. But, we’ve grounded in there with 4ft draft, so caveat emptor.
      You will not be able to do Coon Key Pass without significant anxiety; all of the north of Gullivan Bay entering Coon Key Pass is charted at 5 ft.. Definitely, do that at high high tide.
      The Baron River to Everglades City is doable. Depths on the last mile approach into Everglades City will get to less than 6′, but if you go in and out at high tide, you’ll have no problems. Don’t do early day departures from EC. No problem cruising most of the 10,000 Islands.
      You will not be able to do the “Yacht Channel” through Florida Bay without significant anxiety, if at all. There is almost no tide in Florida Bay; less than 6 inches. Not enough to help. Prolonged winds can affect water levels a lot in Florida Bay. Stay outside around the bottom; run the Hawk Channel. Come it to overnight at Channel 5, or at the 7-Mile bridge. From Marathon, use the 7-Mile Bridge to come north.
      You will be able to enjoy Ft. Myers beach, Ft. Myers and the Caloosahatchee. In the fall, and most springs, you’ll be able to cross Lake O between Ft. Myers and Stuart. Charlotte Harbor is fine. The ICW from Sanibel to Tampa to Tarpon is fine. Research the armpit (Great Bend) very carefully, especially in winter. The Panhandle is fine except for Government Cut at Apalachicola. There, play the tides.
      The West Coast is much, much better cruising than the East Coast. On the east coast, you have miles and miles of very wide river and very narrow channel. You can’t see much, and it’s boring. Southeast Florida is the concrete ditch. From Biscayne Bay around to Tampa/Tarpon, it’s a different world; a cruisers paradise!

      I agree with almost everything that Jim Healy says about cruising the left coast of Florida. We lived in Clearwater for over 50 years and it was a beautiful place to grow up and a great boating venue. However, Jim is mistaken about only one high tide per day. Take a look atbthemtide tables and you will see two highs and two lows almost every day.

      We live in Naples and keep our boat at the Naples City Dock. Our boat draws almost 6ft. We have no issues at the dock or the associated moorings. We also go into Big Marco Pass, which I wouldn’t do at a real low tide. When going into Big Marco, we typically turn north and enjoy the anchorage listed on this site in Johnson Bay.
      I wouldn’t take the channel from Marco to Naples, you have to go outside, which is almost always a pleasurable sail. Coming into Naples (Gordon River) stay on the south side. I usually come in between the first and second red markers.
      From Key West or from Marathon, it is a pretty easy run to Marco or Naples. I would recommend going from Key West to Marathon, then from Marathon north to Cape Sable. This time of year, the winds are typically North to East, so you will be in the lee of Florida at that point and it is a fairly easy sail from there.

    • Report from Caledesi Island State Park Marina, north of Dunedin, FL

      Caladesi Island Marina – Click for Chartview

      As I recall, the entrance channel leading to Caladesi Island State Park Marina (from Hurricane Pass) can be a bit of a challenge for first timers, but otherwise, this is a pretty good facility for those who just want to get away from the maddening crowd. It lies just north of the Dunedin and the Honeymoon Island Bridge

      Caladesi is located immediately north of Clearwater Beach. The beach is still great for shellers, especially near the northern end. Dockage is $1/ft at a slip, $2/ft on a t-dock; 30 amp elec. and water included. 24/7 bathrooms on shore, and a snack bar. Florida senior citizens (65+) pay half. Limit is 14 days, but you can contact them and offer to be a volunteer: free dockage in exchange for 20 hr/wk easy labor. For example we met someone who’s job was to pick up any trash (rare) on the beach. She would carry two bags; one for trash, one for shells.
      There are signs that say “watch out for rattlesnakes” but we haven’t seen any. We have seen lots of armadillos, some raccoons, numerous types of birds, gopher tortoises, and very few people.
      The channel is shallow in places, but marked and doable for our 4’6″ draft. A great place to visit. Chosen twice by “Dr. Beach” as the best beach in the country.

      Wade is spot on about Caladesi Island. It was one of our favorite weekend spots since it was so close to home yet so far away. The beach is absolutely beautiful.
      But Wade, the rattlesnakes are there, although they tend to be in the wooded areas. There used to be a skin mounted on the wall in the rangers office that must be 6′ long. We have seen them that big in the winter, warming themselves in
      a sunny spot on the nature trails.

      When we were in Caladesi last year we caught a line in the prop while in the marina so my husband hopped over to free it. About five minutes after he was back on board a rattlesnake swam by on its way over to the mangroves. We were glad we hadn’t seen it before freeing the line because we might have left the line in the prop rather than risk swimming with the snake. The next day, we also watched as a ranger chased one off the park’s work boat. Still, if you leave them alone, they’ll leave you alone. And Caladesi is so beautiful its worth the stop, even with the snakes!

    • Pelican Bay Anchorages (hard by Cayo Costa Island/State Park), Western Florida ICW Statute Mile 25

      Like Captains Mary and Jerry, we just love anchoring in Pelican Bay,and then dinghying ashore to unspoiled Cayo Costa. Thanks to its being a Florida state park, this barrier island remains almost entirely in its natural state. Hiking across to the ocean side, particularly at sunset, is one of the greatest experiences the western coastline of the Sunshine State has to offer.Unfortunately, the rub is that there is an entrance bar, which, at low tide, carries only about 4 1/2 feet of water. Some local cruisers have told me they have found a deeper route, which will hold 5 feet at MLW.And, in this regard, there is a GREAT You-Tube video giving SOLID ADVICE about entering Pelican Bay, available at:

We dinghied to the dock and walked 3/4 mile across the desert island to the gulf side beach. (There is a regular tram service and bikes for rent, but we preferred to walk ). We had the whole beach to ourselves! Access Fee is $2.00pp. Don’t pass this anchorage! Above will get you in (for 5’ or less) on all but an extreme winter low. There are a couple of bars so don’t freak if you think you’re in but start losing depth again. If you are coming from the south you can turn onto the A-B leg close to B. Start cheating about G71 and aim for a point to the right of B. If the depths get scary jog right until you are comfortable. Turn onto the track when you get to it. Once inside the chart is petty good at identifying the deeper areas. Standard rules apply- if there are a lot of boats in the anchorage and no one is anchored in what looks like a choice spot there is probably a shallow reason. You want to be surprisingly close to the beach from B to C. There is a nice hole around ‘˜E’ and we usually anchor there in about 8-9′. E-F can be a problematic stretch so exercise care. You may stir more mud than you want.KimWe’ve anchored here on 4 occasions and each time we enter and exit from the north Pelican Pass inlet. We stay as close to the north beach as possible as this is where the deepest water is at the entrance channel. Once inside Cayo Costa you’ll find two pools with 8 to 9 foot depths with the balance being between 5 to 6 feet or so.       Pete’s Pier/Kings Bay Marine is the most upstream facility on the Big Bend’s Crystal River. Moving generally west, this stream eventually widens into a broad basin, known and charted as Kings Bay. Pete’s Pier lies on this bay’s northeastern quadrant, east of marker #29.

      Pete’s Pier, so many good things to say about the people here at Pete’s Pier. Its not swanky, but it feels like home to me. Might not be everything you want here, but it damn well sure has everything you could need!

    • Western Florida’s Big Bend Passage, Apalachiacola to Clearwater

      I have often said before, but it bears repeating again, “get twelve cruisers together, and you will give fourteeen opinions about how to best traverse Western Florida’s waterwayless ‘Big Bend’ region.” Every time this topic arises, whether it’s here on the Cruisers’ Net, or some other nautical forum, a wide range of often very useful and informative opinions come to light. That’s just the case below.
      Overnight passages can be memorable, especially when the seas cooperate as Capt. MacMahon describes below. The direct channel to Clearwater Municipal Marina from the Western Florida ICW (there is another entrance from Clearwater Pass Inlet), cuts sharply west, just south of the high-rise Clearwater Beach Bridge.

      Calypso (American Tug 34) crossed the Gulf from Apalachicola to Clearwater on September 22-23. Left Apalachicola at 8:30 a.m. and went down the GICW to East Pass. Exited East Pass into the Gulf shortly before 11:30a.m.
      Weather report was for light winds (5 to 10 mph) out of some derivation of the North for all day and night with waves projected to be 1 to 2 feet. It was a little bouncy going thru East Pass and for the next 45 minutes or so until reaching deeper water. Then, it smoothed out into widely spaced two foot swells which the boat glided over. Conditions got even better as the day progressed and as Calypso worked its way further South until it was essentially smooth throughout the night. Made better time than planned so had to slow down several times in order to arrive after daylight. Stayed out in deeper water (40 feet plus) as approached Clearwater so as to avoid expected crab pots in shallower water. As it got light headed into Clearwater Pass and there were no crab pots off the coast there. Dredging
      equipment was at Clearwater Pass but no problem getting by it. Turned left just after going under the high rise bridge over the pass and went up the side channel to Clearwater Beach Municipal Marina. Somewhat shallow (5 feet over the bar) in the side channel (with about one foot of tide. But, once over the bar depth was fine. The marina has fixed docks and there is a little bit of wake from tour boats (but not bad at all). Showers/heads are not climate controlled. Dock master was helpful. And, it is close to the beach and lots of restaurants/bars.

      We found Panama City to Clearwater area to be the best for us. Leave Panama City in the morning, over night to Clearwater entrance. Anchor between condos and sleep and rest the rest of the day. Don’t like going across that shallow lake east of Panama City. We also found the return trip to Panama City nice also. We would anchor thru the single lift bridge for a day or two. Then there’s the visit to Gano’s bayou for some of the best hospitality ! Thanks,

      We’ve done the Gulf crossing 5 times, all overnighters. We departed from Tarpon Springs or Tampa/St Petersburg going west. Destin, Panama City, Carrabelle going east. We’ve always done the overnighters as our philosophy is that one over night is one overnighter at our trawler speed of 8 mph (7 knts). Leave in the Daylight from either end and plan to arrive no earlier than mid day going east so that you are not looking into the sun and can see the myriad of trap floats that extend a surprising distance off shore some as far as 30+ miles. Just get into port in full daylight going west.
      Having spent time in the arm pit, Steinhatchie and Cedar Key hold no attractions for me so I prefer to get across and not hassle with the shallow entry channels guarded by oyster/clam bed. If you really want to go to them watch your tides and remember the winter northerlies can and does draw the gulf waters down up to +2′ lower than MLLW where it will remain for several days.
      So beware of entering shallow channels with expectations of leaving when ever. The distance we go(departure to arrival point) when doing an overnighter is determined by the weather window and weather at each end which can vary depending upon wind speeds and directions at the different points i.e. following seas over head seas, vice fetch and durations along the planned route. Contrary to some guides in all our crossings we have never been out of range (VHF) contact with a USCG site. Remember, patience is the key to an uneventful and boring (at best) crossing and daylight
      departures and arrivals.

      You ask a good question, what is the best destination for crossing the Gulf, Tarpon Springs or Clearwater. Both are good but slightly different. Tarpon Springs is about 5-6 miles closer if the total crossing distance is critical and marinas there will take reservations, more critical in years past when there were more boaters out there. Clearwater is an easier approach and a few less crab pots to dodge but you would be in the deeper Gulf for a bit longer, important if the west wind is starting to pick up as you finish your crossing. Clearwater has their sunset celebrations that are indeed special but Tarpon Springs has that delicious Greek food that can’t be found many other places.
      To decide what is best port, you will have to serve rum drinks to about a dozen cruisers who have done it before but hope that someone passes out so there can’t be a tie vote. Stay safe,

      Your priorities should be your major guide in planning time from Fairhope to East Pass. On our last trip through that section, it took us over 6 weeks. There are miles of sandy, shell-covered beaches to explore ‘“ usually by yourself this time of year. Anchor at Perdido Key, Shell Island, and Cape San Blas. Don’t miss the Naval Air Museum and Joe Patti’s seafood market in Pensacola. Apalachicola is a quaint town with some of the best oysters and shrimp in the world. The Florida Panhandle is a great cruising destination that should be savored slowly. Too many cruisers rush through the Panhandle concerned about getting to a point to cross the Gulf and miss some outstanding experiences.

      The Power Plant Anchorage lies on the eastern shore of the Anclote River hard by this stream’s mouth and north of marker #18.

      We have anchored just inside the Anclote River heading towards Tarpon Springs. There is a public boat ramp there on the port side going in and the waterway is blocked off just past the ramp, but plenty of room. It is well protected from east winds.

      Royal Palm Marina lines the eastern banks of the Western Florida ICW’s run through Lemon Bay, south of Venice.

      My husband and I went there with my parents. Food was not too good. Some was cold, sandwich had a strange taste.
      Lots of flies buzzing around, it was somewhat unappetizing. Bathrooms were very dirty. I wouldn’t recommend it.

    • Stuart/Martin County Proposed Anchorage Regulations Are A Disaster

      Back in 2009, when intense negotiations were underway to help pass the new Florida Anchoring Law, it was with more than a little trepidation that the Salty Southeast Cruisers’ Net, Boat/US, the Florida MIA, and the SSCA, reluctantly agreed to support a compromise proposal for a Florida Pilot Mooring Field Program, IN RETURN FOR COOPERATION FROM THE FLORIDA LEAGUE OF COUNTIES AND MUNICIPALITIES TO INCLUDE CRUISER FRIENDLY LANGUAGE IN THE BILL, in particular, modifying the definition of “live-aboard vessels.”
      The primary reason for all this nervousness was a deep suspicion that some communities/counties that were approved as one of the pilot mooring field sites, might try and use this program to run off anchored cruisers almost entirely.
      Fortunately, that has largely not happened, but, then again, that’s probably due more to hard work by Boat/US, BARR (Boater’s Anchoring Rights and Responsibilities) and the Cruisers’ Net (among others), rather than any far seeing, cruiser friendly planning on the part of the communities involved in the program.
      Well, I guess there had to be at least one really bad apple in this proverbial barrel, and that entity is Stuart, Florida and surrounding Martin County.
      Their proposed anchorage regulations, which have twice been rejected by the Florida Fish and Wildlife Commission (FWC), would basically outlaw anchoring everywhere in Stuart, and the surrounding waters of the St. Lucie and Indian Rivers, except for a small plot in Manatee Pocket, which is, by the way, is not within easy striking distance of all the businesses and dining attractions in downtown Stuart (though there is a West Marina and another set of restaurants within dinghy distance of the Manatee Pocket proposed anchorage).
      On top of all this, these proposed regulations are Draconian in their penalties, and are so complex as to allow almost unlimited interpretation by local/county officials and law enforcement officers!
      THE CRUISING COMMUNITY MUST UNITE TO OPPOSE THIS PLAN! TO BE BLUNT, IT MUST BE STOPPED!

      This is one of the biggest power grab boondoggles I’ve seen in Stuart for a long time. Read it, download the maps, and imagine how it’s trying to encompass Live-Aboards (specifically exempted by the authorizing statute Sec. 327.4105 F.S.) and all vessels.
      I think the FWCC is more or less on our side in this. Twice they have rejected the ordinance for hearing, but the County and City have not cleaned it up to conform to the law.

      It would affect cruisers staying in Martin County or the City of Stuart waters for ten days or more. It uses the word “vessel” repeatedly without pointing out that live-aboards are exempt under the authorizing statute, sec. 327.4105 F.S.
      It covers all waters in the City Limits and some County waters West of the City, waters off Jensen Beach within 1,000 ft of the shore, and the Manatee Pocket, ie: all the favorite, desirable waters for anchoring in our county and city.
      In effect, it would force cruisers to rent moorings in the City mooring Field and the proposed and permitted Jensen Beach mooring field, or anchor in very small areas of the Pocket. The ordinance is over broad, overly complex, vague, and much more broad than the authorizing statute ever contemplated.
      Our County Commission passed it in response to complaints by waterfront property owners who don’t like to see boats anchored near their homes.
      Public comments are due at FWCC by Nov. 5th; then about the ninth they will publish a summary of comments and the staff recommendation. FWCC will vote it up or down next spring.

      Public Comment on proposed Stuart/Martin County Anchoring and Mooring Ordinance
      The proposed ordinance raises serious concerns that must be addressed by FFWCC before approving the draft, including
      (1) Over-reaching and over-broad regulations that go far beyond the intent of the pilot program;
      (2) Complex and difficult to follow language that makes the ordinance hard to understand and, therefore, extremely difficult to comply with;
      (3) Overly harsh penalties, making it a crime that can result in incarceration for failure to comply with what is an extremely convoluted ordinance enacted as part of a two-year experimental program; and
      (4) Reducing access to navigable waters by failing to provide alternatives to the boating public.
      The revised draft of the proposed ordinance has not addressed the critical issue of over-reaching by the local jurisdictions which appear intent on prohibiting anchoring or mooring in waters of the state throughout Martin County.
      Of the three pilot program areas ‘“ part of the St. Lucie River within the City of Stuart and Martin County, part of the Indian River in the Jensen Beach area, and the Manatee Pocket ‘“ only one area has an existing operational mooring field (the City of Stuart).
      The ordinance does not require an operational mooring field to be available but rather prohibits anchoring and mooring in an area where a mooring field has been issued permits but has not been constructed and is not likely to be constructed before the pilot program ends (since there is widespread public objection to the project and no dedicated funding source).
      This allows the County to prohibit anchoring and mooring in an area where there is no alternative for local recreational boaters, fishermen or cruising vessels.
      There is no justification for prohibiting anchoring or mooring within 1,000 feet of the western shoreline of the Indian River Lagoon. In local discussions, residents have been unable to determine exactly where the 1,000-foot boundary is. How can boaters traveling through the area figure out where the regulated area is when locals can’t identify the boundaries? This is especially troublesome since there’s no existing mooring field within the pilot program area.
      Even the 300-foot boundary set out for the City of Stuart pilot program area and the Manatee Pocket area are excessive and confusing. Since there is no existing mooring field in the Manatee Pocket area, the ordinance requires a mooring permit issued by the Department of Environmental Protection or restricts anchoring and mooring to two defined `anchor areas’.
      The proposed ordinance clearly has gone far afield of the intent of the pilot program to promote establishment and use of public mooring fields and promote public access to waters of the state. The ordinance is designed to limit public access, even criminalizing non-compliance, which may have a chilling effect on boaters and even day fishermen who may be caught in the extremely wide net of these proposed regulations.
      The proposed ordinance also is counter to the statutory pilot program’s intent in that it appears to apply to live-aboard as well as non-live-aboard vessels. The Legislature established the pilot program `to explore potential options for regulating the anchoring or mooring of non-live-aboard vessels outside the marked boundaries of public mooring fields.’ Section 327.4105, F.S. The law provides that `a county or municipality selected for participation in the pilot program may regulate by ordinance the anchoring of vessels, other than live-aboard vessels . . . outside of a mooring field.’
      The Stuart/Martin County proposal appears to apply to live-aboards, using the pilot program as a means of prohibiting live-aboard vessels throughout the pilot program areas. The proposed ordinance does not meet the intent of the pilot program to regulate anchoring or mooring of non-live-aboard vessels.
      The proposed ordinance is convoluted, establishing different regulations for the three separate pilot program areas, and extremely difficult to understand. The revised version of the proposed ordinance has not addressed concerns that were previously raised, such as providing criminal penalties in an experimental, short-lived ordinance that is clearly going to be subject to revision if the pilot program is renewed. A pilot program is, by definition, a `test program’ that should not include criminal penalties at this early stage when those who must comply with it are still trying to figure out the rules.
      Some of the regulations set out in the ordinance appear to conflict with the mooring field operational plan that was previously adopted by Martin County and repeals anchoring restrictions within the Manatee Pocket which have been in place nearly 40 years.
      While the City of Stuart qualified for inclusion in the pilot program by virtue of its operating mooring field, Martin County should not have been included in the program and has not made allowances for its failure to provide viable alternatives to recreational, sports, and cruising boaters and to avoid severe limitations on access to public waterways by drafting a proposed ordinance which contains ambiguous language and overly broad definitions and lacks any foundation in research or studies to support arbitrary distance restrictions.
      The FFWCC should reject the Stuart/Martin County proposed ordinance as drafted.

      Just received the public comment from Virginia Sherlock on behalf of those she is representing in Jensen Beach (see below). I agree wholeheartedly with her objections. Please consider this correspondence on behalf of all the members of Mariners Barr as being in agreement with her stance that the Stuart/Martin County proposal should be rejected. We here at Mariners Barr feel that Stuart/Martin County’s proposed ordinance is so blatantly uncooperative as far as meeting the objectives of the Pilot Program, that they should be removed as a participant from the Program altogether.
      As we all are fully aware, there are many many problems with the ordinance as it is written. Stuart/Martin County is well aware also. We have gone through this process so many times without any real effort on the part of Stuart/Martin County to address those problems, I feel strongly they are wasting our time and yours.
      The bottom line is that Stuart/Martin County has made no real effort to participate. They have made no real effort to address the issues the public and your Office has raised during this entire process. Their persistence in demanding excessive setbacks that have no basis for benefiting the public appear to be tailored for the purposes of prohibiting public access rather than promoting it. Their zeal for criminal penalties is quite disturbing. So much so that there is not a doubt in my mind that if given the opportunity, Stuart/Martin County would enact harsher penalties as soon as it is legal to do so (or even if not quite legal). Their disdain for boaters and cruisers is apparent. It is our stand that, given their history, Stuart/Martin County would more than likely overreach in the enforcement of any ordinances enacted and use them to harass and discriminate against the very public for which the Pilot Program has stated it would promote access.
      Removing Stuart/Martin County from further participation in Florida’s Anchoring & Mooring Pilot Program is the right thing to do.

      `The Secretary of Homeland Security is authorized, empowered, and directed to define and establish anchorage grounds for vessel in all harbors, rivers, bays and other navigable waters of the United States whenever it is manifest to the said secretary that the maritime or commercial interest of the United States require such anchorage grounds for the safe navigation’¦.’ {(personal comment) when the language `authorized, empowered, and directed’ is used it implies sole authority to perform the named act. The Boating Public is a definite minority and it is only by the laws which exist in this country can navigational rights be preserved.}
      Let them have their way, then sue the ******** and do not settle, money talks,,bs walks ..

    • Marco Island, FL Amends Waterway Ordinance and Removes Anchoring Restrictions

      Marco Island is a large community south of the city of Naples on the West Coast of Florida.
      After many, many years of struggle, the city of Marco Island, as you will read below, has finally given up the attempt to regulate anchorage by cruising vessels, contrary to Florida state law. Some of you may remember that back in 2007, I journeyed to Naples, entirely at my own expense, to be an “expert” (boy, did I have them fooled) witness in the trial of Capt. Dave Dumas. This brave individual undertook a “civil disobedience” by anchoring his vessel, contrary to the local statutes, with the express goal of being taken to court by the city of Marco Island. Eventually, he was found innocent, as the local regulations were clearly at variance with Florida state law.
      All this hub-bub has now been superseded by the far more cruiser friendly, but still NOT perfect, 2009 state of Florida anchoring law. Even so, it’s really good to remember those who fought so long and hard for Florida anchoring rights.
      The cruising community owes a HUGE debt of gratitude to the Sailing Association of Marco Island (SAMI), their leaders, and, particularly Captain Dave Dumas. MANY THANKS TO YOU BRAVE WARRIORS!!!

      Subject: Marco Island, FL Amends Waterway Ordinance and Removes Anchoring Restrictions

      Tonight at 6:15 pm at the Sept. 17th meeting of the City of Marco Island council meeting, the anchoring restrictions enacted in May 2006 were repealed by an amendment to their Waterways ordinance. This is the end of an over six year battle. In Jan. of 2007, Capt. Dave Dumas on his Krogen 42 “Kinship” was cited by the Marco Police for violating the anchoring ordinance. In Oct. of 2007, Att. Donald Day and his law firm in Naples, Fl defended Dumas pro-Bono and won a Collier County Court ruling when Judge Rob Crown declared the anchoring provisions of the ordinance unconstitutional after an eight hour hearing on a motion to dismiss the citation. The City finally dropped an appeal to the ruling
      in 2009 and after three more years of prodding the City Council tonight voted unanimously to remove the invalid sections from their code of ordinances.
      The support of Att. Day, the Sailing Association of Marco Is. (S.A.M.I.) and over 25 other organizations and individuals was invaluable in this rare success over “City Hall”. The rights of freedom of navigation will continue to need defending, but this success is sweet. Thanks to all who contributed.

    • Information on Naples Bay and Gordon Pass, Southwestern Florida Coastline

      Gordon Pass is the primary inlet serving the Naples, Florida region. This cut has to be dredged every so often, but, as will read below, depths do not seem to be a problem here at the moment.
      According to our experience, Captains Bruce and Susan are correct about depths not being a problem inside Naples Bay, leading to the primary Naples waterfront, and its two FCYC Yacht Clubs, the Naples City Pier and the Naples Boat Club.
      We would also second the notion expressed below about the two more northerly inlets, Doctors Pass and Wiggins Pass being very much subject to shoaling!

      I noted several references to shallow water in Naples. There are no shallow water issues involved with Naples Bay accessed through Gordon Pass. Naples Bay is where the marinas, yacht clubs, restaurants, shopping, tour boats and large pleasure craft are located. You will not see less than ten feet of water in the channel, even at low tide.
      There are two other Naples passes located further north, Doctors Pass and Wiggins Pass. These passes lead to shallow bays that do not connect to Naples Bay. The passes experience shoaling and are dredged every few years. They are used by mostly smaller boats than used on the Loop.

      We have always enjoyed a stay at Dunedin Municipal Marina. This facility is backed by a beautiful green park, which often hosts local shows and fairs, and one block farther on you will discover the downtown shopping district. Here, don’t dare miss Dining at Kelly’s Bistro. Yummmmmm!

      Dunedin Municipal Marina is convenient to restaurants & shopping, just a 2 block walk to the main downtown area. We liked it so much here we moved from Illinois to Dunedin while on the loop earlier this year.
      From Anclote Key follow the ICW south to G”7″, from Clearwater Inlet follow the ICW north to G”5″.
